Terms and Conditions

The operational terms, service agreements, and legal warranties governing commercial and residential HVAC engagements provided by AB HVAC.

STANDARD SERVICE CONTRACT

Service Agreement

Effective October 14, 2026. Please review these operational standards, customer expectations, and statutory disclosures governing all residential and commercial HVAC services rendered by AB HVAC.

CLAUSE 01

1. Scope of Heating & Air Conditioning Services

AB HVAC ('Contractor') delivers professional residential and commercial heating, ventilation, air conditioning diagnostics, maintenance, system repairs, and turn-key replacements under applicable state contractor license requirements. Work is executed strictly according to mutually approved work authorizations or written diagnostic job tickets.

  • All diagnostic findings and component replacements require formal client authorization prior to physical repair execution.
  • Unforeseen code compliance deficits, pre-existing structural defects, or hazardous material hazards (such as friable asbestos) will pause operations until a revised scope is signed.
  • Emergency dispatch runs are prioritized based on clinical vulnerability, ambient outdoor temperatures, and equipment availability.

CLAUSE 02

2. Site Access, Diagnostics & Service Appointments

The property owner or designated authorized adult representative (18 years or older) must remain present during the service window. Safe, unrestricted access to all electrical panels, thermostat controls, attic spaces, crawlspaces, and outdoor condenser locations is required to perform mechanical testing and maintenance safely.

  • Cancellations or appointment rescheduling must be submitted at least 24 business hours in advance of the scheduled dispatch block.
  • If a certified technician arrives on-site and cannot access the equipment, a standard truck trip fee will be assessed.
  • Domestic pets must be safely secured in a separate area away from the service route, electrical conduits, and work perimeter.

CLAUSE 03

3. SMS & Automated Dispatch Communications

By submitting a phone number through our estimate booking forms, customer portal, or dispatch phone lines, you provide express written consent to receive operational communications via SMS. These transmissions relate exclusively to technician dispatch ETA updates, booking confirmations, emergency readiness, and job status notifications.

TCPA & CTIA COMPLIANCE MANDATE

Opt-Out Protocol: You may revoke messaging consent at any time by replying STOP, END, or QUIT to any incoming text. For direct assistance, reply HELP. Message frequency varies based on scheduled service activity. Standard message and data rates may apply depending on your mobile network carrier. Consent to receive automated dispatch SMS is not a condition of purchasing equipment or receiving emergency service.

CLAUSE 04

4. Pricing, Estimates, Invoicing & Payment Terms

AB HVAC provides transparent upfront pricing based on comprehensive flat-rate technical tables. Diagnostic evaluations require a standard trip fee that covers electrical profiling, refrigerant check, and mechanical troubleshooting. Repair costs are itemized and presented for written approval before replacement work commences.

  • Payment is due immediately upon completion of services, unless pre-arranged commercial net-30 billing has been granted in writing.
  • We accept major credit cards, verified ACH electronic transfers, and approved third-party HVAC financing plans.
  • Balances remaining unpaid past 30 days are subject to a statutory 1.5% monthly late interest charge or the maximum allowed by Texas law.

CLAUSE 05

5. Workmanship Warranties & Limitations of Liability

Contractor warrants all labor and installation artistry for a period of one (1) full year from the project commissioning date, unless otherwise specified on the project agreement. Replacement equipment, condensers, compressors, and electrical parts carry explicit manufacturer pass-through warranties.

  • Warranties are voided if equipment is altered, serviced, or repaired by unauthorized third-party technicians or unlicensed contractors.
  • Routine maintenance items, including disposable media air filter replacements, condensate drain line clearing, and condenser coil flushes, remain homeowner responsibilities.
  • In no event shall AB HVAC be held liable for secondary, incidental, or consequential damages resulting from utility company brownouts, lightning strikes, or extreme weather freezes.

CLAUSE 06

6. Governing Law, Dispute Resolution & Official Contact

This Agreement is governed by and construed in accordance with the laws of the State of Texas, without regard to conflicts of law principles. Any dispute arising under or relating to this agreement shall be submitted first to informal good-faith mediation prior to formal court filing in Smith County, Texas.
